Hey everyone, it's Holland. It's been a while, hasn't it? Became a moderator in the time I've been away.

You've all noticed the whole Game Hacking section is gone. Only the Flash 'Modding' section is still up. You've been busy discussing Nexon's DCMA abuse, and I agree with you. I totally do.

So, a little notice from Dark Byte:

Sure, I could send a dmca-counter notification with all my personal details, and then wait 10 days to see if they file a law-suit, which i'd probably win, but I really don't feel like going through all that hassle
I could even file a suit against nexon for making a false dmca claim, but again, I have better things to do.

This has been quoted from the Moderator section. I applied to try and get more information about this, and talked to Skeem, who sent me here to discuss this with you. That's pretty much all. I'll frequently visit this topic from now on, cheers.

hey.

anyone with half a brain knows nexon are just threatening sites in a vain attempt to get them to bite the bullet and do as they request, i can understand where DB is coming from in this matter, hes right he prob would win a law suit, however where i differ, is i dont believe for one moment nexon would take it that far.

I dunno about the US but in the UK, it wouldnt be worth the money to bother to take someone to court over the DMCA because it would be hard to pinpoint the exact violations without a counter argument. DB was just ending this row before it got out of hand, and rightly so, however if i was in his positions, id have probably replied with something similar to two fingers, and carried on lol.

I was also under the impression that it was DB's host which shut him down until certain content was removed? if this is true, its my opinion, that they did this, because they got scared, and dont actually know the law regarding such matters.

And if you notice in regards to hackers, nexon always refer to the ToS you sign when playing the game, to give an excuse for why a hacker owes them money, no court in the world, reconises ToS as the law, therefore, any amount they suggest to be paid to them for violating the ToS is still subject to a court of law to decide wether the claim is accurate, which i doubt it ever is.

I think there are several issues at hand.. Filing a counter-notice, would be the first step.

There are provisions for frivolous lawsuits as well.  And if Nexon sues you over something that falls under fair-use, then they will end up paying your legal fees..

I'll have to defer to craigslist suing the SC Atty General:

What does that say?  As an operator of a site you are not responsible for the content others post?? ...

This does contradict the DMCA somewhat, but the point is there.

Nexon thinks that suing the people that make the game popular is a good idea..  In the end they are just restricting their userbase.

I am not saying I condone what some hackers do.  for me it was never about abusing people... It was a quest for knowledge.  Crashing servers/channels and generally being a nuisance I do not condone.

lol what next? gamegaurd sueing hackers for circumventing their anti hack protection, it just gets funnier doesnt it.

I think DB is tired of CEF, because he ruined his website even though he has the chance to save it, and according to him can beat Nexon in court with ease.

True it was always ment to be Cheat Engine developement, opening it up to game hacking sections just diverted its true pupose, however, one thing it does now lack, is those people who would have worked to make CE better because of various detections or needed work arounds.

I guess you cant have 1 without the other.
